1. Acceptance of Terms
These Terms of Service ("Terms") are an agreement between you and GETCOLLAB TECHNOLOGIES PRIVATE LIMITED (registered office: Manikonda, Hyderabad 500089, Telangana, India) ("GetCollab", "we", "us"). They apply to your use of the GetCollab website, web application and related services (together, the "Platform"). By accessing or using the Platform you accept these Terms. If you accept on behalf of an organization (for example, a Brand), you confirm you have authority to bind it, and "you" means both you and the organization. If you do not agree, do not use the Platform. In these Terms, a "Brand" is a business or organization that uses the Platform to run campaigns, and a "Creator" is an individual who uses the Platform to offer content or influencer services to Brands.
Our Privacy Policy, Cancellation & Refunds Policy, Shipping & Delivery Policy and Data Deletion Policy form part of these Terms.
2. Eligibility
- You must be at least 18 years old and capable of entering a binding contract under Indian law to create an account or use the Platform
- You must provide accurate, current and complete information when registering and keep it up to date
- You are responsible for keeping your account credentials confidential and for all activity under your account
3. Description of Service
GetCollab operates strictly as an online intermediary marketplace connecting independent Creators and third-party Brands. GetCollab does not employ Creators and does not direct their creative output. The Platform is mainly intended for users in India. Brands outside India may be billed in other currencies through our payment partner. The Platform offers:
- Campaign creation and management tools for Brands
- Creator discovery, profiles and campaign matching
- Deal proposal, negotiation, agreement and workflow tools for Brands and Creators
- Payment handling through our payment processor so that Brands can add money, deals can be funded from that balance and Creators can be paid on approval of their work (Section 7)
- Paid subscription plans and organization seats for Brands
- Communication tools for Brands and Creators
- AI-assisted features, such as campaign drafting and creator matching, that generate suggestions you should review before relying on them
4. Role of GetCollab in Transactions
GetCollab is more than a passive listing service. Depending on the deal, we:
- Record funding, and instruct the release or refund of funds held with our payment processor, according to the deal workflow and these Terms (Section 7)
- Charge the Brand the Payment gateway charges and GST described in Section 8
- Offer paid subscription plans and organization seats for Brands (Section 9)
- Review disputes between Brands and Creators and decide how held funds are paid out (Section 12)
GetCollab is not a party to the commercial agreement between a Brand and a Creator for a specific deal (for example, scope of content, creative direction, usage rights), except for the payment functions described in Section 7. We do not guarantee the quality, timeliness, originality or results of any deliverable. Our liability in connection with our role is set out in Section 17.
5. Account Types and Organization Seats
5.1 Creator Accounts
Creator accounts allow individuals to build a profile, connect social accounts, and respond to or negotiate campaigns and deals with Brands.
5.2 Brand Accounts and Organization Seats
Brand accounts are organized around an organization with one or more seats. The number of seats available depends on the subscription plan shown at getcollab.in/pricing and cannot exceed the plan limit. Each organization has:
- Admin seat(s): Manage the organization's billing, subscription and team members, with full access to its campaigns, deals and payment activity
- Member seat(s): Invited by an Admin to collaborate on campaigns and deals within the limits the organization grants
Organization Admins are responsible for the actions of Members and for removing seat access when a team member should no longer have it.
6. Campaigns
- Draft campaigns: Campaigns that have not been published can be permanently deleted by the Brand
- Published or active campaigns: Once a campaign is published or has active Creator interest it cannot be hard-deleted; the Brand may pause, close or archive it
- Paused campaigns: Temporarily hidden from new Creator discovery and can be resumed by the Brand
- Closed or archived campaigns: No longer open to new proposals; existing deals tied to the campaign continue through completion, cancellation or dispute resolution under Sections 7 and 12
7. Deals, Workflow and Payments Held in Escrow
7.1 Deal Workflow
A deal moves through stages that typically include proposal or invitation, negotiation, agreement, funding, content production, submission, approval and payment. Delivery dates are set per deal. Either party may cancel a deal before it is funded, subject to any campaign-specific terms agreed between them. Once a deal is funded or work has begun, cancellation is handled as described in our Cancellation & Refunds Policy.
7.2 Funding, Holding and Release of Funds
In these Terms, "escrow" means only the arrangement in this Section 7.2. It does not describe any particular legal or regulatory status of the account in which funds are held.
- The Brand adds money to its wallet or campaign balance by payment, and those funds are held as the escrow amount. A deal is funded from that balance. GetCollab does not hold or pool customer funds in its own bank account
- GetCollab maintains a ledger for its own records of the amounts funded, held, released and refunded for each deal, and instructs the payment processor to release or return funds according to the deal workflow and these Terms
- Funds are held until the Creator's deliverables are submitted and approved (or treated as approved under Section 7.3), or the deal is otherwise resolved
- On approval, the Creator's full agreed fee is released to the Creator's GetCollab wallet. A payout transfer charge applies only if the Creator later withdraws to a bank account, as described in Section 8. The Payment gateway charges and GST are not deducted from the Creator's agreed fee
- If a deal is cancelled before completion, or a dispute is resolved in the Brand’s favour, held funds may be returned to the Brand’s balance in whole or in part, as described in our Cancellation & Refunds Policy. The Payment gateway charges and GST are not refunded (Section 8)
- Held funds may be released in part where a deal is completed in part (for example, per milestone)
- Once any deliverable on a deal has been approved, a refund of the remaining held funds is made only through the dispute process in Section 12
You authorise GetCollab and our payment processor to hold, release and refund funds as set out in this Section. Holding and release are also subject to the payment processor’s own terms, banking rules and applicable law, and may be delayed or paused if the processor or a regulator requires it.
7.3 Review Window and Automatic Approval
After a Creator submits a deliverable, the Brand has a review period to approve it or request changes. The review period is set on each deal and is currently 120 hours (5 days) unless the deal shows a different period. If the Brand does not approve or request changes within the review period, the submission is treated as approved and the related funds are released to the Creator, unless a dispute is open on the deal. Brands should therefore review submissions promptly and raise any dispute before the review period ends.
7.4 Disputes
If a Brand and a Creator disagree about whether deliverables meet the agreed terms, either party may raise a dispute through the Platform. While a dispute is open no related funds are released. The process and effect of a decision are in Section 12.
7.5 Collaboration Agreement and Electronic Records
Each deal is documented in a Collaboration Agreement generated on the Platform from the deal terms and accepted electronically by both parties. Electronic acceptance on the Platform (including click-to-accept, one-time password or digital signature) is intended to form a valid and binding contract under the Information Technology Act, 2000 and the Indian Contract Act, 1872. GetCollab is not a party to that agreement except for holding and releasing funds as described in Section 7.2. If the Collaboration Agreement conflicts with these Terms on payment, release or dispute mechanics, these Terms prevail.
7.6 Other Features
Some features, such as affiliate programs, creator wallet withdrawals or credit packs, may be subject to additional terms shown when you use them. Taxes (including tax deducted at source, where applicable) and verification of payout details may apply to payouts.
8. Payment Gateway Charges and Payment Costs
The Brand bears the payment costs. When a Brand adds money to its GetCollab wallet or funds a campaign, it pays: (a) the net amount it wants to add; (b) one charge labelled “Payment gateway charges”; and (c) GST at 18% on the Payment gateway charges. The total payable is shown to the Brand before it pays. The Brand’s wallet or campaign balance is credited with the net amount only. Deals then use that credited balance, and no further Payment gateway charges or GST are added per deal or on release.
The Payment gateway charges and GST are non-refundable. If a deal is cancelled before work starts, or the Brand withdraws unused balance, only the credited (net) amount is returned, never the Payment gateway charges or GST, unless the refund results from GetCollab’s error. Deals funded under an earlier fee model keep the terms shown on their Collaboration Agreement.
The Creator receives the full agreed amount in their GetCollab wallet. When a Creator withdraws to a bank account, the payment processor’s payout transfer charge, plus GST on that charge, is deducted from the withdrawal. The amount the Creator will receive is shown before the Creator confirms the withdrawal.
Payment gateway charges and GST on added money are charged in addition to, and independently of, any subscription fee under Section 9. Current subscription pricing is at getcollab.in/pricing. The total shown to the Brand before it adds money is the amount that applies to that payment.
9. Subscriptions and Billing
- Creator accounts are free to create and to use for participating in campaigns and deals
- New Brand organizations get a 7-day free trial; no card is required to start it. If you do not choose a plan before the trial ends, paid features stop. Plans, prices, seat limits and the yearly-billing discount (10% compared with twelve monthly payments) are described at getcollab.in/pricing, which forms part of these Terms and may be updated from time to time
- Paid plans are billed in advance, monthly or yearly, and renew automatically at the end of each billing period until cancelled. GST is charged in addition unless the price shown says it is inclusive
- You can cancel at any time; cancellation and refund rules are in our Cancellation & Refunds Policy
- If you downgrade or your plan changes, your seats and usage must fit the new plan limits
10. Payments and Payment Risk
- Payments, payouts and subscription billing are processed through the payment processors we engage from time to time
- You authorize us and our payment processors to charge, hold, disburse and refund funds as necessary to operate payments, payouts and subscription billing under these Terms
- Payment processing is outside our direct control and is subject to the processors’ terms and to banks and card networks
- GetCollab is not liable for delays or failures caused by external payment providers or banks, but will make reasonable efforts to help you resolve payment issues connected to funding or payouts. This does not limit the obligations in Section 7 or the liability that cannot be excluded under Section 17.4
11. User Responsibilities
11.1 Brand Responsibilities
- Provide clear and accurate campaign requirements and deal briefs
- Fund deals and pay agreed amounts for approved deliverables in a timely manner
- Review submissions within the review window in Section 7.3
- Respect intellectual property rights in content delivered by Creators
- Not ask Creators to hide or remove a required advertising disclosure, and be able to substantiate any product or service claims in the brief
- Manage organization seats responsibly and remove access for departed team members
11.2 Creator Responsibilities
- Deliver work as specified in the agreed deal terms
- Provide authentic profile information and engagement metrics
- Clearly disclose every sponsored post upfront (for example with "#ad" or the platform’s "Paid partnership" label), as required by the Advertising Standards Council of India (ASCI) Guidelines for Influencers in Advertising and the Guidelines for Prevention of Misleading Advertisements and Endorsements for Misleading Advertisements, 2022 issued under the Consumer Protection Act, 2019
- Maintain professional communication throughout the deal workflow
11.3 Legality and Rights in Media
Users are solely responsible for the legality, licensing and copyright clearance of any media, images or audio uploaded to the Platform or delivered in a campaign, including music, third-party footage, fonts and the likeness of other people.
12. Dispute Resolution
If a Brand and a Creator dispute a deal or the release of funds, we follow this process:
- Step 1 - Direct communication: The parties should first try to resolve the issue through the deal workflow, typically within 7 days
- Step 2 - Dispute review: If unresolved, either party can raise a dispute through the Platform or by writing to contact@getcollab.in with the deal reference and reason. We review the evidence from both parties, generally within 5 business days of receiving it
- Step 3 - Mediation: GetCollab may offer to help the parties reach a settlement
- Step 4 - Determination on held funds: Where funds are held and the parties cannot agree, GetCollab will decide whether they are released, partly released or refunded, based on the evidence and the agreed deal terms. While a dispute is open, no related funds are released
Our decision governs only how held funds are paid out. It is not a judgment on the underlying contract and does not affect either party’s legal rights against the other. The liability limits in Section 17 apply to GetCollab’s role in disputes.
13. Third-Party Integrations (Meta/Instagram and YouTube/Google)
The Platform integrates with Instagram and Facebook (Meta) and YouTube (Google) APIs to provide enhanced services. By using these integrations you agree to:
- Comply with Meta's Platform Terms and, for YouTube, be bound by the YouTube Terms of Service and the Google Privacy Policy
- Accept that Instagram, Facebook and YouTube services are subject to their own terms and policies
- Understand that we are not responsible for changes to, or suspension or termination of, third-party services
We may modify or discontinue an integration if required by Meta or Google or for compliance reasons. How we use data from these services is described in our Privacy Policy.
14. Prohibited Activities
Users are prohibited from:
- Fraud or misrepresentation, including regarding payments, deliverables or the funds held for a deal
- Circumventing the Platform to conduct deal payments off-platform in order to avoid the Payment gateway charges
- Harassment, discrimination or abusive behaviour
- Violating intellectual property or other rights of anyone
- Posting false or misleading information, or sponsored content without the required disclosure
- Using bots or automated systems to manipulate campaigns, interest or metrics
- Attempting to access unauthorized areas of the Platform, including other organizations' seats or data
14.1 Fraud and Misuse
We have zero tolerance for fraudulent activity. The following are strictly prohibited:
- Creating fake profiles or inflating follower counts

- Payment fraud, chargeback abuse or manipulation of held funds
- Impersonating other users, brands or organizations
- Manipulating engagement metrics or reviews
Consequences: We may suspend or terminate accounts involved in fraud, with or without prior notice, and hold or reverse related payments pending investigation, to the extent permitted by law. Users found in violation may be permanently banned.
15. User-Generated Content
Users are responsible for all content they create, upload, post or share on the Platform:
- You represent and warrant that you have all rights necessary to post and deliver the content you submit
- You are responsible for ensuring your content complies with applicable laws, including advertising disclosure rules (Section 11.2)
- GetCollab does not endorse and is not the author of user content
- We may remove content that violates these Terms or the law, and may suspend accounts that repeatedly breach them

We acknowledge reports within 48 hours and act on valid reports within the timelines required under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, including any shorter timeline those Rules set for particular categories of content.
16. Content and Intellectual Property
16.1 User Content
You keep ownership of your content. You grant GetCollab a non-exclusive, royalty-free, worldwide licence, for as long as the content is on the Platform, to host, store, display, reproduce, adapt for formatting and promote it on the Platform and in related Platform marketing, and to process it through our service providers to run the Platform. The licence ends when you remove the content or delete your account, except for copies in backups and records we must keep by law. Rights between a Brand and a Creator in delivered content (including usage rights) are those in their Collaboration Agreement.
16.2 Platform Content
All Platform features, design and functionality are owned by GetCollab and protected by copyright and other intellectual property laws.
17. Platform Availability and Limitation of Liability
17.1 Availability
We work to keep the Platform available but do not guarantee uninterrupted service. Downtime may occur for maintenance, updates or technical issues. Funds held for a deal remain accounted for and will be released or refunded under these Terms once an interruption is resolved.
17.2 Marketplace Role and Outcomes
GetCollab operates strictly as an online intermediary marketplace connecting independent Creators and third-party Brands, and does not employ Creators or direct their creative output. While GetCollab provides escrow of the deal amount, the Platform is not liable for campaign performance outcomes (views, reach, conversions, return on ad spend) or for breaches of contract between a Brand and a Creator. We are not responsible for the quality, accuracy or legality of content posted by users, or for user conduct on or off the Platform.
17.3 Limit of Liability
To the extent permitted by law, GetCollab’s total liability to you for all claims arising out of or relating to the Platform or these Terms is limited to the greater of (a) the fees you paid to GetCollab for the Platform in the 12 months before the claim arose and (b) ₹10,000. To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profit, revenue, goodwill or data, or for loss arising from a dispute between users. The Platform is provided "as is" and "as available" and, to the extent permitted by law, without warranties of any kind.
17.4 What Is Not Limited
Nothing in these Terms excludes or limits:
- Our obligation to release or refund funds held for a deal as set out in Section 7
- Liability for fraud, wilful misconduct or gross negligence
- Liability for death or personal injury caused by negligence
- Any liability, or any right you have as a consumer under the Consumer Protection Act, 2019 or other law, that cannot be excluded or limited under Indian law
17.5 Indemnity
You will indemnify GetCollab against third-party claims, and related losses and reasonable costs, arising from content you submit, your breach of these Terms, or your breach of applicable law (including advertising and intellectual property law), except to the extent caused by GetCollab.
18. Account Suspension and Termination
18.1 Suspension and Termination for Abuse
We may suspend or terminate access to the Platform for breach of these Terms, fraud, harm to other users, or misuse of the Platform or payment systems, and may do so without prior notice where needed to protect users or comply with law.
18.2 Voluntary Account Deletion
You may request deletion of your account at any time through Account Settings or as described in our Data Deletion Policy. We will process the request unless it is blocked under Section 18.3.
18.3 Deletion Blockers
We cannot complete account deletion while any of the following remain open:
- Active or paused campaigns (for Brand organizations)
- Open or in-progress deals
- Funds currently held for a deal involving your account
- Unpaid or pending settlements owed to or by your account
- A wallet balance, unpaid earnings or a payout in progress
- Open disputes involving your account
We will tell you what needs to be resolved before deletion can proceed.
18.4 What Happens on Deletion
Once an account is deleted, we anonymize the account identity data as described in our Data Deletion Policy, and we retain financial, invoice and tax records as long as the law requires. We do not perform a hard wipe of records we are legally required to keep.
19. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Platform is subject to the exclusive jurisdiction of the courts at Hyderabad, Telangana, India.
20. Changes to These Terms
We may modify these Terms from time to time. We will notify users of significant changes by email or in-platform notification, and the "Last updated" date above shows the current version. If a change materially affects your rights, we will give you reasonable notice before it takes effect. Continued use of the Platform after changes take effect is acceptance of the updated Terms; if you do not accept them, stop using the Platform and you may delete your account.
